    Excess Business Loss

Estimate the individual §461(l) limit only after the business-loss rules that come before Form 461.

Updated Reviewed for IRC §461(l); Form 461 instructions; Rev. Procs. 2024-40 and 2025-32; P.L. 119-21

How much business loss can §461(l) defer?

For an individual, the excess is aggregate trade-or-business deductions minus aggregate trade-or-business income or gain minus the annual threshold, after earlier loss limitations. Employee W-2 wages do not enter either side of this calculation.

    • 2026 threshold for this filing status: $256,000
    • Married filing jointly receives twice the nonjoint threshold
    • The disallowed excess enters the NOL system

    Return facts

Enter the Form 461 amount after the confirmed limitations below.

Collected to show the statutory exclusion; wages do not reduce the excess loss.

    Were the prior rules applied?

    Where this estimate stops

Section 461(l) is applied after several other loss limitations, so a standalone gross-loss input can overstate the usable deduction. This tool is for individual/noncorporate returns, assumes the entered Form 461 aggregates already reflect entity and capital-item rules, and does not compute a later-year NOL deduction.

    Questions

When is the excess-business-loss limit applied?

Apply basis, at-risk, and passive-activity limits first, then make the Form 461 capital-gain and capital-loss adjustments. This estimator suppresses its result until those steps are confirmed.

Do W-2 wages count as business income for §461(l)?

No. Section 461(l) and the Form 461 instructions disregard deductions, gross income, and gains from performing services as an employee.

Is an excess business loss lost?

No. The disallowed excess becomes an NOL carryforward for the following tax year. Later-year NOL use is a separate calculation.

    Is §461(l) permanent?

P.L. 119-21 removed the January 1, 2029 sunset for tax years beginning after December 31, 2026. The limitation already applies for the 2025 and 2026 years offered here.
